Jamaat leader Azhar Acquitted of Death Sentence

The full seven-judge appellate bench headed by Chief Justice Syed Refaat Ahmed announced the verdict on Tuesday (May 27) morning.


As a result of this verdict, there is no further obstacle to the release of Jamaat leader Azharul Islam, the lawyers said.


The seven-member bench headed by Chief Justice Syed Refaat Ahmed set May 8 as the date to announce the verdict after completing the appeal hearing.


Earlier, May 6 was fixed for the hearing of Azharul's appeal filed on April 22. The hearing began on the scheduled day at the full bench of the Appellate Division. During the hearing on May 6, the lawyers for the appellant spoke. Then, the hearing was concluded on May 8 and the date for announcing the verdict was fixed. Later, May 27 was fixed for the verdict.


Lawyers Mohammad Shishir Monir and Syed Md. Raihan Uddin were present in the court on behalf of the appellant. Additional Attorney General Anik R. Haque and Prosecutor Gazi MH Tamim participated in the hearing for the state.


The International Crimes Tribunal sentenced Azharul Islam to death on December 30, 2014 in a case of crimes against humanity during the Liberation War. He appealed against this verdict on January 28, 2015.


After the hearing, the Appellate Division upheld his death sentence on October 31, 2019. Later, on March 15, 2020, the full verdict of the Appellate Division was published. Azharul applied to the Appellate Division on July 19, 2020 to review this verdict. After hearing the appeal, the Appellate Division granted leave and ordered on February 26. Then, it was asked to submit a summary of the appeal within two weeks, which was later submitted.


After hearing this appeal, the verdict was announced on Tuesday. Azharul Islam is currently in prison.
